By submitting an order to DepoExpress customer agrees to the following terms:

(1) DepoExpress will complete summaries for its customers in the time specified at the time of order.

(2) All deposition transcripts submitted for summary must be in English. All summaries completed by DepoExpress are in English.

(3) Customer shall be notified by email when the summary is complete.

(4) Once completed, customer may download summary using a link to be provided in email to customer. This email will also include the invoice.

(5) Customers shall be invoiced at $1.75/page of transcript for 5 business day turnaround. Orders must be placed by 10am PST to be completed by 5pm PST 5 business days later. Orders placed after 10am PST are completed by 5pm PST 6 business days later. Weekends and holidays are not counted as business days. Holidays are New Year's Day, Martin Luther King, Jr. Day, President's Day, Memorial Day, Independence Day (observed), Labor Day, Thanksgiving Day, Day after Thanksgiving, day before Christmas, Christmas Day, day after Christmas.

(6) Payment via check or money order is due upon receipt of the invoice. All payments must be in US dollars. Payment that is not postmarked within 20 days of invoice date shall be considered past due. In the event customer does not fully pay invoice within 20 days, DepoExpress may charge 1.5% interest penalty on outstanding balance. Additional 1.5% charges may be assessed for each 30 days (or portion thereof) where there is an outstanding balance. DepoExpress account will be suspended if payment is not received within 90 days of invoice date. Account will be reinstated once payment is received. This agreement shall be governed by and construed under the laws of the State of California applicable to contracts made and to be performed entirely within the State of California. The prevailing party in any action to enforce the terms of this agreement and/or to collect such sums that are due and owing DepoExpress, Inc. shall be entitled to reasonable attorney’s fees and costs.

(7) DepoExpress provides summaries of depositions submitted to us, but does not interpret, comment, or make any assessments regarding the content of the transcripts. It is DepoExpress' policy to not delete or alter information within transcripts, but rather to merely make the information more concise and readable. Notwithstanding the foregoing, summaries are not intended to be a substitute for the written transcript and customers should always rely on the actual transcript for actual testimony. Use of DepoExpress is not intended to and does not create an attorney-client relationship between customer and DepoExpress. It is the policy of DepoExpress not to provide any customer information, including email, password, contact information, order history, deposition or summary contents, or other information to any other parties besides DepoExpress and its subcontractors.

(8) Cancellation Policy: Due to DepoExpress’ rapid standard turnaround time, we may not be able to honor requests to cancel orders that have already been submitted. While we will make every effort to cancel an order that has been submitted, we cannot cancel an order for which the summarizing has already begun.
